These terms and conditions are subject to change and we reserve the right to amend and update it as and when needed, so it is your responsibility to make sure you are aware and agree to the terms and conditions before you use or purchase from this website.
When we refer to “you” or “your,” we are referring to the user of the website and purchaser of the goods. When we refer to “website,” we are referring to www.mybutiki.com. When “we” and “us,” is used we are referring to the business (Mybutiki). By using this website; registering on this website and/or placing an order you agree to be bound by the terms and conditions.
Privacy Policy
Information that is collected from your visit/purchase will not be disclosed to third parties other than if we are required to do so. In such event it may be due to requirements by law and regulations, for the purpose of processing payments, to enable the delivery of your goods that have been ordered or if we think that you are performing any sort of illegal activities and causing harm to others.
Your card details are not seen or stored by www.mybutiki.com as all payments are processed by PayPal on their own secure servers.
Cookies are used to keep track of your visit to www.mybutiki.com. Cookies are used to help recognise you when you visit our website so that your site preferences are maintained and also to enable you to add or remove items from your shopping basket and proceed to checkout at any time. Cookies do not contain confidential information such as your card details, telephone number or address. You may prevent cookies from being stored on your computer by amending your browser settings, however in doing so you may be unable to access certain parts of our website and hinder its functionality.
Your data will be used to complete your order, notify you of any changes to our service and for internal purposes to help us perform our core business functions and improve our service to you. If you have signed up to receive the newsletter we will send you information about products and promotions. Terms of use
You must not misuse this website (www.mybutiki.com) in any way or cause harm or disturbance to other individuals or technological equipment. In the event of any such misuse causing loss or damage to you, your technological items or any other items as a result of using this website, we will not be held accountable. You must not use the content of this site other than for your own personal use. You may not modify or distribute in any way the content of this website.
Placing an order at www.mybutiki.com
We only accept and deliver orders within the UK.
In order to purchase from this website you must be over 18 years of age. When placing an order the customer must register by providing details so that the order and delivery of items can be fulfilled. Once an order is placed the customer will be sent an acknowledgement email to the email address provided at registration. The acknowledgement email will confirm receipt of the order and display the order details, so please check these details carefully and contact us if errors have been made or if you have any queries regarding the order. It is not an order acceptance email so it is not a confirmation of stock availability.
A contract will form between the customer and Mybutiki when a confirmation email has been sent to the customer informing that the goods ordered have been dispatched. The contract will only relate to the goods included in the confirmation of dispatch email.
Payment
Payments are processed through PayPal which accept most debit/credit cards on their secure servers. You do not need to have a PayPal account to pay.
Product Availability
When many customers place an order for a particular product at the same time this may disrupt the stock indicator which is automatically updated. Products are subject to availability and in the event that an item ordered are out of stock, the customer will be informed and the order will be cancelled. We reserve the right to refuse an order.
Price
The prices of products displayed on the website do not include the cost of delivery. The price for delivery is additional to the price of goods. The total payment due for goods including delivery will be displayed before an order is confirmed. Prices may change without notice. So if the price of a product changes and a customer has already placed an order for that product they will not be affected by the price change provided that a confirmation of dispatch has been sent to the customer. In the event that errors occur in the pricing of goods, and prices have been displayed incorrectly, and you have placed an order, we will inform you of the correct price and you will have the choice of either accepting the price or cancelling your order. We reserve the right to amend or correct prices without prior notice and will not supply products which have been incorrectly priced due to errors which may arise.
Images
We cannot guarantee that the detailing of the images of products displayed on this website is completely accurate. The exact colours and details displayed will vary depending on the equipment you use to access this website such as what resolution screens you are using. However we aim to make the images, used for illustrative purposes, as accurate as possible but we are not liable for the differences in which the images are displayed on your equipment.
Size/Fit
The fit of products will vary depending on style. The sizes available will be displayed for each product. Please refer to the specific item that you are interested in for sizing information. When we mention that certain products would be suitable for a certain size, it is only a suggestion and we cannot guarantee for example, when mentioned that a product would fit size 10, that it would fit perfectly on every size 10 as individual body shapes will vary. If you have any questions regarding products please do not hesitate to contact us and we will help you as much as we can. We don’t want you to feel disappointed if you receive a product and find that it doesn’t fit so we would like to provide you with as much help as possible so that you are happy with your purchase.
Delivery
We only deliver to the UK. Postage and packaging charge is £3.95 per order. Your order will be sent via Royal Mail by recorded delivery so a signature will be required upon receipt of the order. Once cleared payment has been received, we aim to dispatch orders the same day or next working day (excludes Weekends and Bank Holidays). You should receive your order within 2-8 working days. For deliveries to the Scottish Islands, Highlands and Isle of Man, please allow up to 10 working days to receive your order.
Please note that if you have not received your items, it is required by Royal Mail that you wait 15 working days before the package is considered to be lost.
We cannot be held responsible for any delays caused in the delivery of your goods once the goods have left our site for delivery by Royal Mail. Any postal strikes or delays which may occur are beyond our control and we cannot be held accountable.
We do not deliver to BFPO addresses
Returns Policy
If you wish to return products please return it in its original, saleable condition within 14 days of receipt. Please make sure items do not have any scents or marks which make them unsaleable. In the event of a refund we will refund the price of the product. Delivery charges are non refundable. Refunds will be made to the original method of payment used by you to pay for the goods. Refunds will be issued as soon as possible and within 30 days of confirmation of you being entitled to a refund.
For hygiene reasons we do not offer refunds or exchange on pierced jewellery such as earrings unless it is found to be faulty.
If you want to return a product because it’s defective or you received the wrong items, we will refund you the amount for the products and the delivery charge if we feel that after examining the products they are found to be defective. If the products are not defective we are entitled to recover any direct costs incurred.
If goods are damaged, defective or the wrong items were sent, you must inform us within 2 days of receiving the goods and send the goods back to us within 7 working days in order to get a refund. Email: sales@mybutiki.com
If you wish to return products please firstly send an email to request a Return Authorization Number and include your name, order ID, items you’d like to return, reason for return and whether you’d like a refund or exchange to sales@mybutiki.com. We cannot accept returns without this number.If you want an exchange include what item you’d like to exchange with. If you want to exchange an item you will not be charged for delivery on the new item requested. This is only applicable once for your first exchange. If the new requested item is of a higher value than the original item you purchased we will send you a request to pay the difference in the price of the items via PayPal (you do not need to have a PayPal account). If your new requested item is of a lower value than the original item purchased, we will refund the difference in the price of the items.
Customers are responsible for the cost of returning items. We recommend that you send goods back to us by recorded delivery as we are not responsible for items that we do not receive.
7 Day Cooling-Off Period
Under the Distance Selling Regulations consumers have seven working days beginning the day after receipt of goods, to cancel a purchase unless it is for customised products. In the event of a cancellation during the cooling off period we will provide a full refund but you must return the cancelled items to us at your own cost. If we do not receive the cancelled items we may arrange to collect them from you at your cost. We recommend that you send items by recorded delivery when returning items. To cancel an order during the cooling off period you must inform Mybutiki in writing by sending an email to sales@mybutiki.com
Managing your account
Please be aware that you are responsible for ensuring that your account and password are managed properly in terms of ensuring that your password is kept secure and nobody has access to it. You must also ensure that any details in your account are kept up to date.
Waiver
If you violate the terms and conditions and we do not exercise our rights this does not mean that subsequent/further violations of the terms and conditions are not acted upon or that it is a waiver of our rights.
Disclaimer
The accuracy of the content of this website cannot be guaranteed. You agree to use this website at your own risk. Mybutiki will not be held liable for any damages whether direct or indirect caused as a result of the use of this website. Mybutiki shall not be held responsible for any loss incurred as a result of using this website directly or indirectly.
